LAW OFFICE OF WAYNE I. NOVAK

Defending your rights to the fullest.

Assault and Battery
Assault and Battery are two separate and distinct crimes.  Assault is when one engages in behavior to put another in fear of receiving a battery.  Assault can be as minor as a Class C Misdemeanor but can also be classified as a Felony depending on the circumstances.  Battery occurs when actual physical contact is initiated and can classified as a Class A misdemeanor as well as a Felony depending on the circumstances.  For more information as to the classification of the Assault or Battery you have been charged with see 720 ILCS 5/12 et al.

Experience Matters
I have vast experience in the area of criminal defense.  Whether I am defending a misdemeanor violation or a serious felony offense, I will do everything possible to achieve the best possible result for my client.  The ultimate goal in every case I take on is to keep the charge of my client's permanent record if at all possible.  The sooner you contact me, the sooner I can preserve evidence that is routinely destroyed by most police departments within the first 30 days (booking room video, police dispatch recordings and any other audio or video recordings that may have been made routinely are destroyed after 30 days), which could ultimately impact whether you win or lose your case.  I will take a critical look at police conduct to make sure none of your constitutional rights were violated, and if they were, I will fight to get your case dismissed before a trial would even occur.
