Sexual Assault
Sexual Assault more commonly referred to as Rape is generally thought of as the act of committing sexual penetration by use or threat of force.  In the typical Sexual Assault case consent is the biggest issue and usually determines whether one is found guilty or innocent at trial.  However one can be charged with sexual assault in numerous other situations on the basis of the age of the alleged victim and the age of the accused as well as the mental capacity of the alleged victim.  For the Illinois Statute definitions of the various sexual assault charges please see the following:
